A. Your Obligations (Service Customers)

You represent and warrant that you have obtained any necessary consents to contact your leads/customers using the Service and that your message content and practices comply with applicable laws and carrier rules.

End users may opt out of future messages by replying STOP. You agree not to interfere with, disable, or attempt to circumvent opt-out mechanisms.

You agree to pay all applicable subscription fees and any one-time setup/activation fees if offered. Fees are non-refundable except where required by law or explicitly stated otherwise on our site or in a written agreement.

7. Service Availability and Changes

We aim for reliable operation but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features at any time. We may also impose reasonable limits to protect the Service, our users, or providers.

8. Third-Party Providers

The Service relies on third-party providers (e.g., telecommunications and hosting). Their outages, policy changes, or enforcement actions may affect Service performance. We are not responsible for third-party services outside our reasonable control.

You retain rights to your message templates and content you provide. You grant us permission to process that content solely to operate and support the Service (e.g., sending your configured messages, forwarding replies, troubleshooting issues).

You may stop using the Service at any time. We may suspend or terminate your access if we believe you violate these Terms, applicable laws, or provider/carrier policies, or if required for compliance or security reasons.

The Service is provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law.

13. Limitation of Liability

To the extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue, lost business, or lost data arising from your use of the Service.

Our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the three (3) months before the event giving rise to the claim.

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these Terms, laws, or carrier rules.
